1. Acceptance of Terms

By installing and using ConsentGuard (“the App”), you agree to these Terms of Service. If you do not agree, please uninstall the App.

2. Description of Service

ConsentGuard is a Shopify app that allows merchants to add consent blocks (checkboxes, banners, and acknowledgments) to their checkout flow. The App records consent events for audit and compliance purposes.

3. Subscription Plans

ConsentGuard offers Free, Pro ($9/month), and Business ($19/month) plans. Paid plans include a 7-day free trial. You can upgrade, downgrade, or cancel at any time through the App’s billing page. Charges are billed through Shopify’s billing system.

4. Merchant Responsibilities

• You are responsible for ensuring your consent blocks comply with applicable laws and regulations in your jurisdiction.
• ConsentGuard provides the tool to collect and record consent; it does not provide legal advice. Consult a legal professional to ensure your consent text meets your regulatory requirements.
• You are responsible for configuring appropriate retention periods for your audit log data.

5. Data and Privacy

Our handling of data is described in our Privacy Policy. By using the App, you agree to our data practices as described therein.

6. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The App depends on Shopify’s platform and APIs, which are outside our control. We are not liable for downtime caused by Shopify or third-party services.

7. Limitation of Liability

ConsentGuard is provided “as is” without warranties of any kind. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to loss of data, revenue, or compliance failures.

8. Termination

You may stop using ConsentGuard at any time by uninstalling it from your Shopify store. Upon uninstallation, your data will be deleted in accordance with our Privacy Policy. We reserve the right to suspend or terminate access to the App if these terms are violated.

9. Changes to Terms

We may update these Terms of Service from time to time. Continued use of the App after changes constitutes acceptance of the revised terms.
